Warranty

This Warranty describes how Conba, which operates under GRC Australia Pty Ltd (the “Site”, “we”, “our” and /or “us”) warrants our products when you make a purchase.


Concrete Characteristics

We appreciate and embrace the inherent beauty of concrete, which lends each bespoke piece to a distinct and visually captivating appeal. As per our Characteristics Guide, concrete naturally showcases unique characteristics such as textural flow lines, pin holing (surface holes), crazing, exposed fibres, colour, and surface variation. These distinctive features are a testament to the authenticity of our concrete products and do not in any way compromise their structural integrity for their intended purpose. To ensure complete satisfaction with the product's aesthetics, we strongly advise requesting sample pieces before purchasing to ensure your approval of the product.


Warranty Conditions

This Warranty covers products purchased after 25 May 2023.
1. We provide the following warranty for all our Products purchased in Australia and New Zealand from us online, in-store and at any of our authorised resellers for use in domestic installations. For the avoidance of doubt, our Products purchased outside Australia or New Zealand from other sources, including grey, parallel, or direct imports, are not covered by this warranty as our Products may not meet local regulations and you should refer to the terms and conditions that accompany your Product or any warranty provided by the retailer or relevant sales company in the relevant country of purchase.
2. This Warranty covers our Products and applies to defects which have arisen solely from faulty materials or workmanship in the Products. For the avoidance of doubt, defects that arise as a result of the following or detailed in the exclusions part of the document are not covered by this warranty:
(a) abuse, misuse, neglect, maltreatment, excessive stress or strain;
(b) excessive water pressure or temperature;
(c) excessive artificial, natural, or man-made heat or ultraviolet light;
(d) exposure to weather conditions and chemicals;
(e) repairs or alterations (other than by an accredited and licensed technician who has been approved by us); and
(f) attachments of accessories of any kind (other than approved Phoenix Tapware attachments that are correctly installed).
3. For the purpose of this Warranty, our Product is a product which:
(a) was manufactured by or on behalf of us;
(b) was sold by an authorised reseller or distributor of our products; and
(c) was purchased in Australia or New Zealand for use in Australia or New Zealand.
4. This Warranty commences on the date of purchase and will continue for the relevant periods set out in the warranty period session of this document, page, or site.
5. It is the installer/consumer’s responsibility to ensure:
(a) the Product is not damaged prior to installation;
(b) the Product has all of its components; and
(c) required care and maintenance is performed over the life of the Product.
6. The Warranties provided are personal to the Consumer who acquires the Product from us or a relevant retailer for their own consumption or use and not for resale or resupply. Accordingly, claims made pursuant to this warranty cannot be made by anyone other than the Consumer.
7. If the Warranty is covered by Structural only then the warranty covers only the repair or replacement of the defective Product and does not include any refunds, credits, or reimbursements for associated costs such as but not limited to, labour, installation, removal, shipping, or disposal.
8. In this Warranty, special order, custom or discontinued items may be replaced by a reasonable alternative product and/or finish should a valid warranty claim occur.
9. For custom projects and “custom” marked products, you (the consumer) must conduct and ensure compliance in accordance with your country’s relevant standards, building codes and regulations. Our designs are provided as an estimate only which is based on our knowledge of best practices. We accept no liability for any issues or damages arising from custom projects. Clients acknowledge their responsibility and release us from any associated liability.


Warranty Period

Residential

We warrant that the below Products which are purchased by consumers for use in a residential home will be free from all defects in materials and workmanship for the periods specified below. Conditions apply to special orders, and custom or discontinued items.
• Basins and Baths – 24 months - Structural Only
We warrant for a duration of 24 months from the date of purchase that our range of concrete products will be structurally adequate and free from any material or labour defects that could affect the integrity of the product in accordance with applicable consumer protection laws.


Commercial

We do not warrant any Products which are purchased by consumers for the intended use other than in a residential home (e.g., hotels, aged care facilities, hospitals, schools, factories, or motels).


Warranty Exclusions

The warranty may become voided in occasions where there is a defect in the Product where:
(a) the Consumer is unable to provide proof of purchase or equivalent documentation which confirms that the relevant Product was purchased from a us or an authorised distributor or reseller;
(b) the relevant Product is not a product that was manufactured or imported by us with the intention of being supplied in Australia or New Zealand;
(c) the relevant Product was not purchased by the Consumer as a brand-new product;
(d) the relevant Product was not installed by an accredited and licensed technician, including a plumber or tradesperson, in accordance with the manufacturer’s installation instructions provided with the Product.
(e) the relevant Product was not installed to the relevant National Standards and State Regulations;
(f) the damage to the relevant Product amounts to wear and tear;
(g) the relevant Product requires routine cleaning, care and maintenance that has not been adhered to;
(h) the relevant Product was damaged as a result of accident, misuse (including use for incorrect applications), incorrect installation, cleaning or maintenance, unauthorised modification, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories or exposure to abnormally corrosive conditions, chemical, adhesives or sealants;
(i) the relevant Product sealing system has been damaged due to scratching, scourers, heat, abrasive surfaces, chemicals, accidental chipping, dropping, uncontrollable accidents, exposure to weather, improper installation, contact with incompatible substances, or commercial public use.
(j) the relevant Product has been exposed to harsh or abnormal environmental elements such as rain and wind;
(k) the relevant Product has been exposed to water pressures and or temperatures that fall outside the following parameters: Note: AS/NZS 3500.1-2018 (Clause 3.3.4) specifies 500kPa maximum water supply pressure at any outlet within a building for new installations.
(l) the relevant Product has been exposed to water temperatures above 50°C
(m) the relevant Product has been exposed to water quality that falls outside the parameters of potable water in the jurisdiction into which the Products are supplied, including as a result of any changes to the water quality advised by a government body or regulatory agency from time to time;
(n) the relevant Product was used incorrectly (e.g. non-potable water);
(o) the relevant Product exposed to thermal shock caused by prolonged exposure to hot items without protection;
(p) the relevant Product was purchased as an ex-display product;
(q) the relevant Product has been serviced, repaired, waxed or resealed without our written approval or sealer;
(r) the relevant Product has been altered, amended, modified or has in any way been changed from its original sale condition without our prior written approval;
(s) a flow regulator was not installed, or installed incorrectly, in respect of the relevant Product (if applicable)
(t) the relevant Product’s finish has been damaged as a result of:
(i) installation or post installation use; or
(ii) adhesives, sealants or abrasive cleaners, etc.; or
(a) the consumer has failed to observe our care and maintenance instructions and not followed it.

Making a claim

Submitting a claim

To make a warranty claim, the consumer must lodge the claim using the online Warranty Claim Form accessible from on our website. Claims must be lodged as soon as possible, but no later than ten (10) Business Days after the consumer first becomes aware of the damage or defect. To make a valid claim, the following documentation must be supplied to us:
(a) proof of purchase (e.g. invoice or receipt) or certificate for occupancy or handover documentation for new homes;
(b) plumbing installation receipts (if applicable); and
(c) quality photographs and a detailed description.
Claims will be processed through our Customer Service team and each claim will be issued with a claim number which is recorded by us. In the case of a valid claim and deemed necessary, we will process the refund once the faulty product is received and undergoes a final inspection at our warehouse. We reserve the right to replace the exact product if available. In the case that it is no longer available, we will offer a credit for the invoiced amount (excluding shipping).
Valid claims
If a Consumer makes a valid claim under this Warranty and none of the exclusions set out previously apply, we will, in our sole discretion, either:
(a) repair the relevant part of the Product; or
(b) replace the relevant part of the Product with a product of identical specification (or where the Product is superseded or no longer in stock, with a product of as close a specification as possible).
Products presented for repair may be replaced by refurbished products of the same type rather than being repaired. Refurbished parts may be used to repair the Products.
We will not be liable for any claims for modifications, associated costs related to labour, installation, removal, disposal or damaged in relation to and caused by the faulty product.


Invalid claims

Should any warranty claim be made and, in the opinion of us or one of our authorised Service Agents that the problem was from faulty installation, use of the Products or not following the care and maintenance procedures or from some other cause other than a manufacturing defect to the Products for which we are responsible, We have the right to charge a service fee for each service staff attending the consumer’s premise and claim.

Product Care and Maintenance

If treated in accordance with the below advice and instructions, and any specific instructions provided with a Product, Our Products will endure for many years. These instructions are based on our expert knowledge and experience but are not to be construed as a legal warranty or liability on our party.

All products

Products should be cleaned with mild liquid detergent or soap and water.
Never use harsh detergents, solvents or acidic cleaners, citrus-based cleaners, lime scale removers, household vinegar, and cleaning agents containing acetic acid on any Products as these will scratch and damage the surface. Additionally, the use of wax-based furniture cream should be avoided as these can result in a build-up of deposits, which could detract from the appearance.
Do not use undue pressure when wiping.
Under no circumstances should products be installed using silicone.
We reserve the right to alter or amend this warranty offer in writing at any time.
